These Terms & Conditions (“Terms”) govern the use of the Air Times Experience website, any related digital platforms, and all bookings, enquiries, and services offered by Air Times Experience (“Air Times”, “we”, “our”, “us”). By accessing our website, submitting an enquiry, or booking an experience, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Nature of Services
​
Air Times Experience curates private aviation sightseeing flights, celebratory experiences, and aviation-inspired hospitality offerings in partnership with licensed aviation operators and qualified pilots. Unless explicitly stated otherwise, Air Times does not operate aircraft, and flights are conducted by certified third-party aviation service providers under applicable South African Civil Aviation Authority (SACAA) regulations.

2. Bookings and Payment

Bookings are subject to aircraft, pilot, and operational availability

A booking is only confirmed upon receipt of full payment or required deposit, as communicated

Prices are subject to change until payment is made

Payment deadlines, deposit amounts, and settlement terms will be communicated during booking
-
Failure to make payment within agreed timeframes may result in cancellation of the booking
-
All guests are required to review our Refund & Cancellation Policy, which forms part of these Terms

3. Safety, Weather, and Operational Conditions
​
Aviation operates under strict safety protocols. Flights may be delayed, rescheduled, or cancelled due to:

Weather conditions

Air traffic or regulatory restrictions

Technical or maintenance requirements
-
Pilot or operator safety decisions
-
Unforeseen operational circumstances
Final safety authority rests solely with the pilot and licensed operator.

Where a flight cannot proceed due to the above reasons, Air Times will:

Reschedule the experience where possible, or
-
Apply our Refund Policy where rescheduling is not feasible
If aviation conditions are approved as safe and compliant, but a guest chooses not to fly, the booking will be treated in accordance with our Refund Policy and normal cancellation rules.

4. Customer Responsibilities
​
Guests are required to:

Arrive on time at designated meeting locations

Provide accurate information during booking

Present identification where required for aviation compliance

Comply with all safety instructions provided by crew and staff

Respect aircraft rules and regulations

Air Times and its Operator reserve the right to refuse service to any guest who:

Is intoxicated or under the influence of substances
-
Engages in unsafe or disruptive conduct
-
Fails to comply with safety briefings or instructions
-
Provides false or misleading booking information
In such cases, no refunds will apply.

5. Experience Conditions
​
Certain experiences may have:

Passenger weight limits

Seating limitations
-
Luggage or personal item restrictions
-
Minimum or maximum passenger requirements
These constraints are implemented for safety and operational reasons and must be respected.

6. Photography, Media, and Brand Use
​
Air Times may capture images, video, or promotional media during experiences for marketing, brand, documentary, or communication purposes. Guests who do not wish to be included must inform Air Times via email prior to their experience.
Guests may capture personal content provided that:

Safety is not compromised

Aircraft operator rules are followed

Content does not misrepresent Air Times or its partners
Use of Air Times branding for commercial or media purposes requires written consent.

7. Liability and Indemnity
​
Guests acknowledge that aviation, while professionally regulated, carries inherent risks.

To the fullest extent permitted by law:

Air Times, its partners, directors, employees, and service providers shall not be liable for any loss, injury, damage, claim, delay, expense, or inconvenience arising directly or indirectly from participation in any experience.

Air Times is not liable for indirect, consequential, or incidental damages, including missed events, travel disruptions, or third-party losses

All aviation operations are covered under the licensed operator’s aviation insurance.
Nothing in these Terms limits liability where such limitation is prohibited by South African law.

8. Website Use
​
All website content is provided for general information and marketing purposes and may be updated or modified at any time without notice.
Unauthorised copying, misuse, or reproduction of website material, imagery, or brand assets is prohibited.

9. Privacy and Data Protection
​
Air Times complies with the Protection of Personal Information Act (POPIA).
Personal information collected is handled in accordance with our Privacy Policy, which forms part of these Terms.

10. Vouchers, Promotions, and Special Offers

Vouchers and promotional offers may carry unique terms and validity periods

Vouchers are generally non-refundable unless required by law

Transferability of vouchers is subject to Air Times approval

Promotional pricing may not apply retroactively

11. Third-Party Services
​
Some experiences involve third-party service providers including aviation operators, caterers, hospitality venues, and event partners. Air Times is not responsible for failures or actions of third-party providers beyond reasonable control but will act in good faith to support guest resolutions.

12. Governing Law and Jurisdiction
​
These Terms are governed by the laws of the Republic of South Africa.
Any disputes arising in connection with these Terms shall be subject to the jurisdiction of South African courts.

13. Amendments to Terms
​
Air Times reserves the right to amend these Terms at any time. The most recent version will always appear on our website. Continued use of our services constitutes acceptance of updated Terms.
